TERMS OF SALES

In order to be able to benefit from the services offered by Camping Bois de Gravière, we ask that you carefully read the general conditions below.

These conditions govern the sale of stays and are valid at the time the order is placed. Booking a stay implies full acceptance of our general conditions.

DEFINITIONS:

ORDER or RESERVATION or RENTAL: Purchase of Services.

SERVICES: seasonal rental of accommodation or bare “tourism” pitches.

ACCOMMODATION: Tent, caravan, mobile leisure residence and light leisure accommodation.

Article 1 - RESERVATIONS & PAYMENT

The reservation

• Reservations are made on site, by telephone, by post or online on the website www.premium.secureholiday.net/fr/5092/
• All reservations must be accompanied by a payment including a deposit corresponding to 30% of the total rental price and any additional services.
• The reservation becomes effective only with the agreement of Camping Bois de Gravière, after receipt of the deposit and after receipt of the reservation contract duly completed and signed.
• Any Order placed on the website www.premium.secureholiday.net/fr/5092/ constitutes the formation of a contract concluded at a distance between the Client and the Service Provider.
• All reservations are nominative and cannot, under any circumstances, be transferred.
• It is the Customer's responsibility to verify the accuracy of the reservation and to immediately report any errors to the service provider.
• In accordance with Article L.121-21-8 of the Consumer Code, we inform you that the provision of hosting services, which must be provided on a specific date or period, are not subject to the right 14 day withdrawal period.

payment

• Sums paid in advance are installments. They constitute an advance on the total price owed by the Customer.
• For reservations made more than 30 days before the start of the stay, a deposit of 30% of the price of the amount of the services reserved is required when the reservation is made.
• THE BALANCE OF THE STAY is to be paid 30 days before the date of arrival. In the event of non-payment of the balance by the customer at the latest 30 days before the date of the beginning of the stay, the campsite reserves the right to cancel the reservation and to offer the accommodation for rent again.
• For reservations made less than 30 days before the start date of the stay, full payment must be made at the time of booking at the campsite (30% deposit + balance of the stay).
• No deduction will be made for late arrival or early departure.

Article 2 - PRICES & TOURIST TAX

The rates

• The prices or information published on our website www.premium.secureholiday.net/fr/5092/, are the basic prices not including the optional services (texts and photos not contractual). The price fixed at the time of the reservation includes the VAT in force. The contractual price may be subject to modification within the legal and regulatory limits, when variations in the applicable VAT rates occur, between the date of reservation and the date of payment of the balance.
• Rates are subject to change during the season.
• Promotions cannot be applied to a reservation already paid in full or in part.
• The payment requested from the customer corresponds to the total amount of the purchase, including its costs.
• An invoice is drawn up by the campsite and given to the client on request at the time of payment of the balance of the price or on the day of his arrival.

The tourist tax

• The tourist tax is to be paid when paying for the service and appears clearly on the invoice. Tourist taxes vary according to the municipalities and countries. Its amount is determined per person and per day and varies according to the destination.
• The tourist tax is collected on behalf of the municipalities and may be increased by an additional tax.
• The cost of the tourist tax will be likely to change during the year and may therefore increase or decrease the total amount of the stay.

Article 3 - YOUR STAY

Rentals

• Arrival in the mobile homes is from 4 p.m. and departures before 10 a.m.
• Each rental contains all the kitchen and table equipment as well as bedding (except sheets and towels). A cleaning sheet is distributed on arrival and an inventory is displayed in the accommodation. The tenant is required to check it and report any anomaly on the same day.
• Any dissatisfaction concerning the state of cleanliness, or the general state of the rental must be notified no later than 24 hours after arrival, in order to allow it to be remedied. No complaint will be admissible more than 24 hours after the day of arrival.
• The basic package is 2 to 9 spaces depending on the type of rental. Housing is provided for a determined number of occupants. Under no circumstances may it be occupied by a greater number of people (children and babies included). In the latter case, the campsite manager is entitled to refuse any additional person.
• Minors unaccompanied by their parents or a legal guardian cannot be admitted.
• The plans and photos of the accommodations are given for illustrative purposes. The layout and features of parts may vary from model to model.
• On the day of departure indicated on your contract, the rental accommodation must be vacated before 10 am. The accommodation will be returned in a perfect state of cleanliness. If the accommodation has not been cleaned before your departure, you will be asked for a cleaning fee of a minimum value of €70 including tax. The inventory can be checked, any broken or damaged object will be at your expense, as well as the restoration of the premises if necessary.
• The deposit will be returned to you at the end of your stay after deducting the allowances withheld, on supporting invoices, for any damage noted by the exit inventory. The withholding of the deposit does not exclude additional compensation in the event that the costs exceed the amount of the deposit.

The slots

• Arrival on the pitches is from 3 p.m. and departures before 11 a.m.
• The basic package includes the pitch for the tent, caravan with 1 vehicle or motorhome for 1 or 2 people, as well as access to sanitary facilities and reception facilities.

Campers are responsible for looking after their personal items (bicycles, etc.). The campsite declines all responsibility in the event of an incident relating to the civil liability of the camper. All customers must comply with the provisions of the house rules.

Article 4 - SECURITY DEPOSIT

• For accommodation rentals, a security deposit of two deposit checks of €230 and €70 (cleaning and smoking allowance) is required from the Customer on the day the keys are handed over.

These checks will be returned to you at the end of your stay or returned after your departure, after deducting any costs for cleaning the premises and/or cleaning the cushions and/or the value of the missing or damaged equipment.

• In order to facilitate your arrival, this deposit will be requested by email 10 days before the start of your stay. This can be done online via the platform of our partner SWIKLY, up to €300, including a €70 cleaning deposit. This deposit is made by simple credit card imprint and is therefore not debited from your account.
• The full amount of this security deposit will be returned to you no later than 3 days after your departure if the accommodation is left clean, minus the compensation retained for any damage caused, unpaid services, loss of keys given on your arrival .
• This deposit does not constitute a limit of liability.

Article 5 - PETS

• Pets are accepted in our campsite (except categories 1 and 2), subject in particular to presentation of vaccination certificates, subject to payment of an additional flat rate when booking.

Article 6 - MODIFICATIONS, INTERRUPTION AND CANCELLATION

If you have not subscribed to the free stay option:

It is recalled that in application of the provisions of article L221-28 12° and following of the Consumer Code, none of the services offered by the campsite is subject to the right of withdrawal. Consequently, any cancellation by the customer after booking and before departure will result in:

• In the event of cancellation up to 30 days before the scheduled arrival date, the retention by the campsite of the deposit paid by the customer.
• In case of cancellation from 29 days before the scheduled arrival date, the obligation for the customer to pay the full price of the stay.
• Any reservation cancellation must be made in writing and sent to the campsite by registered letter with acknowledgment of receipt. Deadlines are calculated on the date of receipt of the letter with AR.
• When booking, it is possible to subscribe to the free stay option to benefit from flexible conditions for cancellation and modification of the stay.
• If you have not subscribed to the Freedom stay option, you can no longer modify your reservation once it has been validated.

If you have subscribed to the free stay option:

• Up to 15 days before arrival, the stay can be modified free of charge depending on availability if it takes place during the current season.
• The stay can be postponed to new dates (within the same season) The stay cannot be postponed to the following season.
• Any price difference at the time of the modification between the old and the new stay will be borne by the customer. If the new stay turns out to be cheaper than the old one, no refund of the difference will be made.
• From 14 days before arrival and for any stay started, no refund can be made, the stay can no longer be modified.
• Any request to increase the length of your stay will be made subject to availability and the rates in effect.
• Any request to reduce the duration of your stay is considered as a partial cancellation and will be subject to the terms and conditions for cancellation and interruption of stay.
• Up to 30 days before arrival, the stay can be canceled free of charge and the amounts incurred will be fully refunded.

From 29 days and up to 15 days before arrival, the stay can be canceled subject to a fixed cancellation fee of €100. Only the sums committed at the time of the cancellation request will be reimbursed after deduction of the cancellation costs and excluding the cancellation guarantee & administrative costs.

• For any request to cancel your stay, contact us via the contact form or by email info@camping-besse.com. Deadlines are calculated on the date of receipt of the request.

Article 7 - CANCELLATION IN THE EVENT OF A PANDEMIC (valid with or without the free stay option)

• In the event of administrative closure of the establishment during the dates of the reserved stay (which is assimilated to a measure of total or partial prohibition of reception of the public, insofar as the Customer is directly concerned by the application of this measure) decided by the public authorities, and which is not attributable to the Service Provider, the sums paid in advance by the Customer for the reservation of the stay will be the subject of a voucher for an amount corresponding for unused nights, valid for two years. In case of refusal by the customer of this voucher, it will be refunded, on request.
• The Service Provider cannot, however, be held liable for additional compensation beyond this reimbursement of the sums already paid for the reservation of the stay.
• Any cancellation of the stay duly justified by the fact that the Customer would be affected by COVID 19 (infection) or another infection considered to be part of a pandemic, or would be identified as a contact case, and that this situation would call into question his participation in the stay on the scheduled dates will result in the issuance of a non-refundable credit note valid for 18 months.
• Any processing and management fees as provided for in the general conditions shall be retained by the Service Provider.
• In the event that the Customer is forced to cancel the stay in full due to government measures preventing participants from traveling (general or local confinement, travel ban, border closure), even though the camping is able to fulfill its obligation and welcome Customers, the Service Provider will issue a credit note corresponding to the sums paid by the Customer. This non-refundable and non-transferable credit will be valid for 18 months.
• In all cases, the Customer must provide proof of the event making him eligible for this right to cancellation.
• Apart from the reasons mentioned above, any interrupted or shortened stay (late arrival, early departure) due to the customer cannot give rise to a refund or a voucher.

Article 8 - NON-COMPLIANCE WITH PAYMENT CONDITIONS

• Payments made by the Customer will only be considered final after effective collection of the sums due by the Service Provider.
• In the event of late payment and payment of sums owed by the Customer beyond the time limit fixed above, or after the date of payment appearing on the invoice addressed to the latter, penalties equal to 3 times the rate of interest the equal in force as well as a lump sum recovery indemnity of €40, will automatically and automatically be acquired by the Service Provider, without any formality or prior formal notice.

Article 9 - CUSTOMER OBLIGATIONS

• The Customer hosted on a site or in accommodation must be insured for civil liability. A certificate of insurance may be requested from the Customer before the start of the service.
• Rules of procedure are displayed at the entrance to the establishment and at reception. The Customer is required to read and respect it. It is available on request.
• Each client is responsible for disturbances and nuisances caused by people staying with him or visiting him. Failure to comply with the rules of procedure may result in the expulsion of the camper.
• For any delayed departure, you may be charged an additional day at the current nightly rate.

Article 10 - PROVIDER'S OBLIGATIONS - GUARANTEE

• The Service Provider guarantees the Customer, in accordance with the legal provisions and without additional payment, against any lack of conformity or hidden defect, resulting from a defect in the design or production of the Services ordered.
• In order to assert his rights, the Client must inform the Service Provider, in writing, of the existence of defects or lack of conformity within a maximum period of 24 hours from the provision of the Services.
• The Service Provider will reimburse or rectify or have rectified (as far as possible) the services deemed to be defective as soon as possible and at the latest within 2 days of the finding, by the Service Provider, of the defect or defect. Reimbursement will be made by bank check addressed to the Customer.
• The Service Provider's guarantee is limited to the reimbursement of the Services actually paid for by the Client. The Service Provider cannot be considered responsible or in default for any delay or non-performance resulting from the occurrence of a case of force majeure usually recognized by French case law.

Article 11 - RIGHT OF WITHDRAWAL

• Activities related to the organization and sale of stays or excursions on a specific date or during a specified period are not subject to the withdrawal period applicable to distance and off-premises sales, in accordance with the provisions of the article L221-28 of the Consumer Code.

Article 12 - PROTECTION OF PERSONAL DATA

• The Service Provider, drafter of these, implements personal data processing which has the legal basis:
• Either the legitimate interest pursued by the Service Provider when pursuing the following purposes:

- prospecting

- the management of the relationship with its customers and prospects,

- the organization, registration and invitation to events of the Service Provider,

- the processing, execution, prospecting, production, management, follow-up of requests and customer files,

- the drafting of documents on behalf of its clients.

• Either compliance with legal and regulatory obligations when implementing processing for the purpose of:

- the prevention of money laundering and terrorist financing and the fight against corruption,

- invoicing,

- accountability.

• The Service Provider only keeps the data for the duration necessary for the operations for which they were collected and in compliance with the regulations in force.
• In this respect, customer data is kept for the duration of the contractual relationship increased by 3 years for the purposes of animation and prospecting, without prejudice to storage obligations or limitation periods.
• In terms of preventing money laundering and terrorist financing, the data is kept for 5 years after the end of the relationship with the Service Provider. In terms of accounting, they are kept for 10 years from the end of the accounting year.
• Prospect data is kept for a period of 3 years if no participation or registration in the Service Provider's events has taken place.
• The data processed is intended for authorized persons of the Service Provider.
• Under the conditions defined by the Data Protection Act and the European Data Protection Regulation, individuals have a right of access to data concerning them, rectification, interrogation, limitation, portability, erasure.
• The persons concerned by the processing implemented also have the right to object at any time, for reasons relating to their particular situation, to the processing of personal data having as a legal basis the legitimate interest of the Provider, as well as a right of opposition to commercial prospecting.
• They also have the right to define general and specific directives defining the way in which they intend to exercise, after their death, the rights mentioned above.

Article 13 - INTELLECTUAL PROPERTY

• The content of the websites www.premium.secureholiday.net/fr/5092/ , www.campin-besse.com and www.camping-superbesse-auvergne.com are the property of the Service Provider and are protected by French and international laws relating to intellectual property.
• Any reproduction, distribution, total or partial use of this content is strictly prohibited and is likely to constitute an offense of counterfeiting.
• In addition, the Service Provider remains the owner of all intellectual property rights to the photographs, presentations, studies, drawings, models, prototypes, etc., produced (even at the request of the Client) with a view to providing the Services to the Client. . The Client is therefore prohibited from any reproduction or use of said studies, drawings, models and prototypes, etc., without the express, written and prior authorization of the Service Provider, who may condition it on financial consideration.

Article 14 - APPLICABLE LAW - LANGUAGE

• These General Terms and Conditions of Sale and the resulting transactions are governed by and subject to French law.

Article 15 - DISPUTES

They do not apply to rentals of pitches intended for the reception of mobile leisure residences (mobile homes) which are the subject of a “leisure” contract.

The Customer is required to read it before placing an order. The choice and purchase of a Service is the sole responsibility of the Customer.

• These General Terms and Conditions of Sale apply to the exclusion of all other conditions of the Service Provider, and in particular those applicable to other Services marketing channels.
• These General Conditions of Sale are accessible at any time on the website and shall prevail, where applicable, over any other version or any other contractual document. The version applicable to the Customer is the one in force on the website or communicated by the Service Provider on the date the Customer places the Order.
