DEFINITIONS:

ORDER or RESERVATION or RENTAL: Purchase of Services.  

SERVICES: Seasonal rental of accommodations or bare “tourism” sites.

ACCOMMODATIONS: Tent, caravan, recreational mobile home, and lightweight recreational dwelling.

ARTICLE 1 - SCOPE OF APPLICATION

• These General Terms and Conditions of Sale apply, without restriction or reservation, to all rentals of accommodations or bare campsites at the LES TOURNESOLS campground, operated by Mr. R. Hooghiemstra, to non-professional customers (“The Customers” or “the Customer”), on his website www.camping-sarthe-les-tournesols.fr or by phone at 02 43 20 12 69, by mail to Le Landereau 72140 Le Grez or by email to campinglestournesols@orange.fr, or at a location where the Service Provider markets the Services. 
• The main features of the Services are presented on the website www.camping-sarthe-les-tournesols.fr or in writing—either on paper or electronically—in the event of a reservation made by means other than a distance order. 

The Customer is required to review them before placing any order. The selection and purchase of a Service is the sole responsibility of the Customer. 

These General Terms and Conditions of Sale apply to the exclusion of all other terms and conditions of the Service Provider, and in particular those applicable to other channels for marketing the Services. 

These General Terms and Conditions of Sale are available at any time on the website and shall, where applicable, take precedence over any other version or contractual document. The version applicable to the Customer is that in force on the website or communicated by the Service Provider on the date the Customer places the Order. 

Unless proven otherwise, the data recorded in the Service Provider’s computer system constitutes proof of all transactions concluded with the Customer.

In accordance with the provisions of the French Data Protection Act and the European General Data Protection Regulation, the Customer has, at any time, the right to access, rectify and object to the processing of all their personal data—provided such processing is not essential for the fulfilment of the order and the stay, as well as any related matters—by writing, via email and providing proof of their identity, to: campinglestournesols@orange.fr 

• The Customer confirms that they have read and accepted these General Terms and Conditions of Sale, either by ticking the box provided for this purpose before proceeding with the online booking process, as well as the general terms and conditions of use for the website www.camping-sarthe-les-tournesols.fr, or, in the case of a booking made offline, by any other appropriate means.

IT IS FORBIDDEN TO CONNECT AN ELECTRIC VEHICLE TO THE CAMPING SITE. IN THE EVENT OF FAILURE TO COMPLY WITH THIS RULE, A FIXED CHARGE OF €300 WILL BE BILLED TO THE CUSTOMER AND THEY WILL BE EXPELLED IMMEDIATELY.

ARTICLE 2 – BOOKINGS

The booking procedures are as follows:

The booking is subject to the following terms and conditions:

• Short stays of 1 to 6 nights inclusive must be paid in full at the time of booking 
• For stays of 7 nights or more, a deposit of 30% of the total cost of the stay is required, plus booking fees and cancellation insurance if taken out. The balance is payable 30 days before the Guest’s arrival date. 
• Any booking made less than 30 days before arrival must be paid in full by bank transfer or credit card.
• No refund will be given in the event of late arrival or early departure.

It is the Customer’s responsibility to check the accuracy of the Order and to notify the Service Provider immediately of any errors. The Order shall only be considered final once the Service Provider has sent the Customer confirmation of acceptance of the Order, either by email or post, or upon signing the contract in the event of a booking made directly at the premises where the Service Provider offers the Services. 

• Any Order placed on the website www.camping-sarthe-les-tournesols.fr constitutes the formation of a distance contract between the Customer and the Service Provider. 

All Orders are personal and may not, under any circumstances, be transferred.

For safety reasons, minors not accompanied by their legal guardians throughout their stay are not permitted on the campsite.

The campsite does not accept groups.

In accordance with Article L. 221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services. The 14-day withdrawal period does not apply to the booking of Accommodation or a Pitch.

ARTICLE 3 – RATES

PITCH: This pitch is designed to accommodate one or more of the Customer’s tents, a caravan or a motorhome. The maximum capacity is 6 people. An electrical hook-up is available.

ACCOMMODATION: The price of the stay includes the hire of the accommodation based on the number of people specified by the campsite, and parking for one vehicle.

• The Services offered by the Service Provider are provided at the rates in force on the website www.camping-sarthe-les-tournesols.fr, or in any of the Service Provider’s information materials, at the time the Customer places the order. Prices are quoted in euros, excluding VAT and including VAT. 
• The rates take into account any discounts that may be offered by the Service Provider on the website www.camping-sarthe-les-tournesols.fr or in any information or communication material. 
• These rates are firm and non-negotiable during their period of validity, as indicated on the website www.camping-sarthe-les-tournesols.fr, in the email or in the written proposal sent to the Customer. Beyond this period of validity, the offer lapses and the Service Provider is no longer bound by the prices. 

The campsite operates a dynamic pricing policy (adjusting prices in line with fluctuations in demand). As a result, rates are subject to change, either upwards or downwards. Consequently, it is possible that customers may have paid different prices for the same stay. Customers who have paid the highest price shall under no circumstances be entitled to a refund of the difference between the price applicable to them and the promotional price or lower price that another customer may have benefited from under the dynamic pricing system. An invoice is issued by the Seller and provided to the Customer at the time of the Customer’s stay.

3.1. TOURIST TAX 

The tourist tax, collected on behalf of the local authority, is not included in the rates. The amount is determined per adult per day and varies depending on the destination. It is payable when the Service is paid for and is shown separately on the invoice. In 2026, it is €0.44 per day per adult.

3.2. ECO-FEE

The eco-fee, charged at €0.36 per day per adult, is not included in the rate.

ARTICLE 4 - TERMS OF PAYMENT

4.1. DEPOSIT

Any sums paid in advance are deposits. They constitute a down payment on the total amount owed by the Customer.

Stays of 1 to 6 nights inclusive: the deposit is 100% of the stay. In the event of cancellation of the stay by the Customer (without the Customer having taken out cancellation insurance), the campsite will not refund any amount.

Stays of 7 nights or more: a deposit equivalent to 30% of the total price of the Services ordered is required when the Customer places the order. It must be paid at the time of booking. It will be deducted from the total amount of the order. The balance for the stay must be paid in full 30 days before the arrival date (failing which the booking will be cancelled). If you book less than 30 days before your arrival, the stay must be paid for in full at the time of booking. In the event of cancellation of the stay by the Customer (without the Customer having taken out cancellation insurance), a full or partial refund will be made depending on the date of cancellation, in accordance with the following scale: The 30% deposit will be retained by the campsite in the event of cancellation up to 31 days before arrival; no refund will be made for cancellations made less than 30 days before arrival.

4.2. PAYMENTS

Payments made by the Client shall only be deemed final once the amounts due have been received by the Service Provider. 

In the event of late payment or failure by the Client to pay the sums due beyond the deadline set out above, or after the payment date stated on the invoice sent to the Client, late payment penalties calculated at a rate of 2% of the total price (including VAT) for the provision of the Services shall automatically and ipso jure be payable to the Service Provider, without any formality or prior notice. 

Late payment shall result in the immediate payment of all sums owed by the Client, without prejudice to any other action which the Service Provider may be entitled to bring against the Client in this regard. 

4.3. FAILURE TO COMPLY WITH PAYMENT TERMS

Furthermore, the Service Provider reserves the right, in the event of failure to comply with the payment terms set out above, to suspend or cancel the provision of the Services ordered by the Client and/or to suspend the performance of its obligations following a formal notice that has remained without effect. 

4.4 METHODS OF PAYMENT

By credit card, bank transfer, holiday vouchers, Connect holiday vouchers, cash or cheque.

ANCV holiday vouchers must be duly completed and sent to the campsite by registered post with acknowledgement of receipt to the following address: Camping les Tournesols, Le Landereau, 72140 Le Grez. They must be submitted with their original stubs, all detached from the cheque book and not stapled or attached to any other medium. The ‘Holder’s Name’ field must be completed.

ARTICLE 5 - PROVISION OF SERVICES

5.1. PROVISION AND USE OF SERVICES

The rental accommodation (mobile home and lightweight leisure accommodation) may be occupied from 3 pm on the day of arrival and must be vacated by 10 am on the day of departure.

The pitch (tent, caravan, motorhome) may be occupied from 2 pm on the day of arrival and must be vacated by 12 noon on the day of departure.

The balance for the stay must be paid in full 30 days before the arrival date (failing which the booking will be cancelled). 

Accommodation and pitches are intended for a specific number of occupants at the time of booking and may under no circumstances be occupied by a larger number of people. 

Accommodation and pitches must be left in the same clean condition as on arrival. If this is not the case, the tenant will be required to pay a flat-rate cleaning fee of €60. Any damage to the accommodation or its fixtures and fittings will result in immediate repairs at the tenant’s expense. The inventory at the end of the tenancy must be exactly the same as at the start of the tenancy. 

5.2. SECURITY DEPOSIT

For accommodation rentals, a security deposit of €250 is required from the Customer on the day the keys are handed over and is returned to them on the final day of the rental, less any repair costs. 

This deposit does not constitute a limit of liability.

ARTICLE 6 – DELAY, INTERRUPTION OR CANCELLATION OF STAY BY THE CUSTOMER

No reduction will be granted in the event of a delayed arrival, early departure or a change in the number of people (whether for the whole or part of the planned stay).

6.1. CHANGES

In the event of a change to the dates or the number of people, the Service Provider shall endeavour to accommodate requests for date changes as far as possible, subject to availability, without prejudice to any additional costs that may arise; this is in all cases merely an obligation of means, as the Service Provider cannot guarantee the availability of a pitch or accommodation, or of an alternative date; an additional charge may be applied in such cases. 

Any request to shorten the duration of the stay shall be treated by the Service Provider as a partial cancellation, the consequences of which are governed by clause 6.3.

6.2. INTERRUPTION 

An early departure shall not give rise to any refund from the Service Provider. 

6.3. CANCELLATION 

6.3.1 WITHOUT CANCELLATION INSURANCE TAKEN OUT FOR STAYS OF 1 TO 6 NIGHTS INCLUSIVE: In the event of cancellation of the booking by the customer after its acceptance by the Service Provider more than 30 days prior to the scheduled arrival date, for any reason whatsoever, the 100% deposit paid at the time of booking (including booking fees and cancellation insurance, if taken out), as defined in Article 4 - TERMS OF PAYMENT of these General Terms and Conditions of Sale, shall be automatically retained by the Service Provider as compensation and shall not give rise to any refund. 

6.3.1 WITHOUT CANCELLATION INSURANCE FOR STAYS OF 7 NIGHTS OR MORE: In the event of cancellation of the booking by the customer after its acceptance by the Service Provider more than 30 days prior to the scheduled arrival date, for any reason whatsoever, the 30% deposit paid at the time of booking (including booking fees and cancellation insurance, if taken out), as defined in Article 4 - PAYMENT TERMS of these General Terms and Conditions of Sale, shall be automatically retained by the Service Provider as compensation and shall not give rise to any refund. From 30 days to less than 30 days prior to arrival, the campsite retains 100% of the amount paid.

6.3.2 WITH CANCELLATION INSURANCE:

If CAMPEZ COUVERT cancellation insurance has been taken out, the customer will be reimbursed for the holiday (minus administration fees and the insurance premium) by the insurer upon presentation of valid supporting documents, or 70% without supporting documents. The claim must be made by the customer on the insurer’s website Declare.fr: Claims and claims management 

Important: The refund does not include administration fees or the insurance premium.

ARTICLE 7 – CUSTOMER’S OBLIGATIONS

7.1. THIRD-PARTY LIABILITY INSURANCE 

Customers staying on a pitch or in accommodation must have civil liability insurance. Proof of insurance may be requested from the Customer before the start of the service.

7.2. ANIMALS

Pets (except dogs classified as categories 1 and 2) are only permitted on pitches.

7.3. RULES AND REGULATIONS

A set of rules and regulations is displayed at the entrance to the site and at reception. The Customer is required to read and comply with these rules. They are available on request. In the event of non-compliance with the rules and regulations, the campsite reserves the right to enforce them and, if necessary, impose any necessary penalties, up to and including the Customer’s expulsion from the campsite without a refund of the cost of the stay. IT IS FORBIDDEN TO PLUG AN ELECTRIC VEHICLE INTO THE CAMPING SITE. IN THE EVENT OF FAILURE TO COMPLY WITH THIS RULE, A FIXED CHARGE OF €300 WILL BE BILLED TO THE CUSTOMER AND THEY WILL BE EXPELLED IMMEDIATELY.

ARTICLE 8 – OBLIGATIONS OF THE SERVICE PROVIDER – WARRANTY

The Service Provider warrants to the Client, in accordance with the relevant legal provisions and without any additional payment, against any lack of conformity or hidden defect arising from a fault in the design or performance of the Services ordered. 

In order to assert their rights, the Client must inform the Service Provider, in writing, of the existence of any defects or lack of conformity within a maximum of 24 hours from the provision of the Services. 

The Service Provider shall refund, rectify or arrange for the rectification (where possible) of the services deemed defective as soon as possible and no later than 2 days following the Service Provider’s discovery of the defect or fault. The refund shall be made by crediting the Client’s bank account or by bank cheque sent to the Client.

The Service Provider’s guarantee is limited to the refund of the Services actually paid for by the Client. The Service Provider shall not be held liable or in default for any delay or non-performance resulting from the occurrence of a force majeure event as generally recognised by French case law.

• The Services provided via the Service Provider’s website www.camping-sarthe-les-tournesols.fr comply with the regulations in force in France.

ARTICLE 9 – RIGHT OF WITHDRAWAL

Activities relating to the organisation and sale of holidays or excursions on a specific date or during a specified period are not subject to the withdrawal period applicable to distance and off-premises sales, in accordance with the provisions of Article L221-28 of the French Consumer Code.

ARTICLE 10 – PROTECTION OF PERSONAL DATA

The Service Provider, the author of these terms, processes personal data on the following legal basis: 

• Either the legitimate interest pursued by the Service Provider when it pursues the following purposes: 

- marketing

- managing relationships with its customers and prospects,

- the organisation, registration and invitation to the Service Provider’s events,

- the processing, execution, prospecting, production, management and follow-up of client requests and files,

- the drafting of documents on behalf of its clients.

• Or compliance with legal and regulatory obligations when it processes data for the following purposes:

- the prevention of money laundering and terrorist financing, and the fight against corruption,

- invoicing,

- accounting.

The Service Provider retains data only for the period necessary for the purposes for which it was collected and in accordance with the regulations in force.

In this regard, customer data is retained for the duration of the contractual relationship plus three years for marketing and prospecting purposes, without prejudice to retention obligations or limitation periods.

With regard to the prevention of money laundering and terrorist financing, data is retained for 5 years after the end of the relationship with the Service Provider. For accounting purposes, it is retained for 10 years from the close of the financial year.

Prospect data is retained for a period of 3 years if no participation in or registration for the Service Provider’s events has taken place.

The data processed is intended for authorised personnel of the Service Provider.

In accordance with the provisions of the French Data Protection Act and the European General Data Protection Regulation, individuals have the right to access, rectify, query, restrict, transfer and erase data concerning them.

Data subjects affected by the processing operations also have the right to object at any time, on grounds relating to their particular situation, to the processing of personal data where the legal basis is the Service Provider’s legitimate interest, as well as the right to object to marketing communications.

They also have the right to set out general and specific guidelines defining how they wish the above-mentioned rights to be exercised after their death

Data subjects have the right to lodge a complaint with the CNIL.

ARTICLE 11 - INTELLECTUAL PROPERTY

• The content of the website www.camping-sarthe-les-tournesols.fr is the property of the Service Provider and its partners and is protected by French and international intellectual property laws.

Any reproduction, distribution or use, in whole or in part, of this content is strictly prohibited and may constitute an offence of copyright infringement.

Furthermore, the Service Provider retains ownership of all intellectual property rights in the photographs, presentations, studies, drawings, designs, prototypes, etc., produced (even at the Client’s request) for the purpose of providing the Services to the Client. The Client shall therefore refrain from any reproduction or use of the said studies, drawings, models and prototypes, etc., without the express, prior written authorisation of the Service Provider, who may make such authorisation subject to financial consideration. 

The same applies to names, logos or, more broadly, any graphic representation or text belonging to the Service Provider or used and disseminated by them.

ARTICLE 12 – APPLICABLE LAW – LANGUAGE

These General Terms and Conditions of Sale and the transactions arising therefrom are governed by and subject to French law.

These General Terms and Conditions of Sale are drafted in the French language. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.

ARTICLE 13 – DISPUTES

Any disputes arising from purchase and sale transactions concluded under these General Terms and Conditions of Sale, concerning their validity, interpretation, performance, termination, consequences and effects, and which cannot be resolved between the Service Provider and the Customer, shall be submitted to the competent courts in accordance with the provisions of ordinary law.

In accordance with the provisions of the Consumer Code concerning ‘the mediation process for consumer disputes’, the customer is entitled to make use, free of charge, of the mediation service offered by Camping les Tournesols (SARL les Tournesols). The ‘consumer law’ mediator provided is:

ARTICLE 14 – PRE-CONTRACTUAL INFORMATION – CUSTOMER ACCEPTANCE

The Customer acknowledges having been provided, prior to placing their Order, in a legible and comprehensible manner, these General Terms and Conditions of Sale and all the information and details referred to in Articles L 111-1 to L 111-7 of the French Consumer Code, in addition to the information required under the Order of 22 October 2008 relating to the provision of prior information to consumers on the characteristics of rental accommodation in outdoor leisure facilities, and in particular: 

- the essential characteristics of the Services, taking into account the means of communication used and the Services concerned; 

- the price of the Services and any associated charges; 

- information regarding the Service Provider’s identity, postal address, telephone number and email address, and their activities, if these are not apparent from the context; 

- information regarding statutory and contractual guarantees and the procedures for invoking them; the functionalities of the digital content and, where applicable, its interoperability; 

- the possibility of resorting to contractual mediation in the event of a dispute; 

- information regarding the terms of termination and other important contractual conditions.

• The fact that a natural person (or legal entity) places an order on the website www.camping-sarthe-les-tournesols.fr implies full and unconditional acceptance of these General Terms and Conditions of Sale, which is expressly acknowledged by the Customer, who waives, in particular, the right to rely on any contradictory document that would be unenforceable against the Service Provider
